Terms of Use of Myenglishteacher.eu

This is a legal agreement between you and MyLanguageTeacher Kft., also referred to as Myenglishteacher.eu. Please read these terms carefully as they regulate the use of services of Myenglishteacher.eu. In case you would like to use one of the services supplied by Myenglishteacher.eu, you have to accept the provisions of the Terms of Use.

Myenglishteacher.eu reserves the right to update, revise, supplement and otherwise modify these terms, and to impose new or additional terms and conditions on the use of services at any time without notice. Such modifications shall be effective immediately and incorporated into these terms.
It is the user’s responsibility to review the possible modifications of the Terms of Use from time to time. By using the services following such modifications, you accept and agree with these modifications.

1. Subject of contract

Myenglishteacher.eu provides the following services to its registered Members and the Members paying the service fee:

• It stores the data of the language teachers or the language school (together: Member) in an ordered database.
• The Member can change its data any time.
• Visitors of the Myenglishteacher.eu website are able to search this database. By choosing the features of the way of teaching and of teachers, visitors can determine the teacher or language school exactly matching their criteria.
• The Member’s data appear in the search list (and visible for the visitors) only if the member has at least 1 credit on her/his account.
• Visitors can send a message to the chosen Member via the website. Each message from visitors to the Member decreases the credits of the Member.
• Myenglishteacher.eu notifies the Member of the visitor’s message via e-mail.
• The Member can view the visitor’s message by logging on to the website with its personal username and password.

The service of Myenglishteacher.eu will be suspended without prior notice after the credits of the Member ran out. This will not involve the termination of the Member’s registration; the Member will remain in the database as specified in the Privacy Policy, but will not be shown for the visitors searching the database. The Member can restart the service without further registration by buying new credits.

2. Establishment of the contract

No contract is concluded between Myenglishteacher.eu and the visitors of the website viewing the database of teachers and language schools.
The contract between Myenglishteacher.eu and the teachers or language schools willing to be included in the database includes the following steps:

• Myenglishteacher.eu registration – the Member undertakes to provide real and correct data required by the system during registration.
• Myenglishteacher.eu confirms the registration via e-mail to the address given by the Member.
• The Member confirms the registration by clicking on the link given in the confirmation e-mail.
• Buying credits by payment through the chosen payment method.

The contract becomes effective immediately after the system recognized that the Member clicked on the link given in the confirmation e-mail.

3. Registration

The services of Myenglishteacher.eu can be used only by registered Users (Members). Members must be natural persons who are at least 16 years old, or undertakings functioning as language schools. During the registration process, the Member must fill in all mandatory fields with true, accurate, current and complete information about her/him as prompted in the registration form.

Condition of the registered membership is the acceptance of registration by Myenglishteacher.eu. Myenglishteacher.eu has the right to deny the registration request without further explanation, or to withdraw it at any time, especially in case of providing false or imperfect data, or in case of a breach of Myenglishteacher.eu’s and other Members’ trust, or any other misuse.

Myenglishteacher.eu expressly recommends that the Members regularly modify their password; these passwords should not be disclosed to anyone, and stored in a place inaccessible to others. Myenglishteacher.eu shall not be held liable for the arising damages and disadvantages if the Member loses his/her password. If the Member forgets his/her password, Myenglishteacher.eu will send a new password on request to the e-mail address given at registration. The Member shall undertake the exclusive liability for the confidential and secure handling of his/her username (e-mail address) and password. The Member shall not give out these data to third parties and shall not use somebody else’s username and password, and shall not try to use somebody else’s access.

The registration software of Myenglishteacher.eu will formally verify the data entry mistakes prior to sending the contractual statement, and in case of formally incorrect or imperfect data on the registration sheet, it will require their correction or completion.

After the termination of registration, no registration is possible with the username/password combination of the terminated registration.

Myenglishteacher.eu may verify if the Member observes the provisions of the Terms of Use, and reserves the right to enforce them with or without the Member’s notification.

4. Member data (Registration data)

The Member declares that the data given at registration (“Registration data”) are given according to the reality on the registration forms, as well as on the Member’s datasheet. The Member agrees to maintain and update the Registration Data as necessary to keep it true and complete. Any membership account on which Myenglishteacher.eu has reasonable grounds to suspect that Member’s information is untrue, inaccurate or incomplete Myenglishteacher.eu reserves the right to suspend the right to use the service. The Member agrees to allow Myenglishteacher.eu to store and use the Member’s data for the service effected for consideration. The Privacy Policy Statement refers to the usage of the Members’ data by Myenglishteacher.eu.

The Member is allowed by Myenglishteacher.eu to upload a personal photo to his/her datasheet, and may provide personal presentation in an editable text window. These uploaded contents cannot be contents that

• violate applicable law or prevailing moral or ethical standards;
• infringe upon third-party trademarks, patents, industrial and other registered designs, copyrights, trade secrets or other third-party rights;
• are obscene, racist, pro-violence, pornographic in nature, or otherwise endanger the development, wellbeing or character of children and youths;
• are offensive, harassing or libellous in nature;
• contain chain letters, snow-ball or pyramid systems;
• refer to personal data of third parties without such parties’ express consent;
• create the chance of an alternative contact with the teacher/language school (phone number, e-mail address, personal website address);
• are commercial in nature and/or serve especially advertising purposes.

5. Termination of contract

The contract will be terminated with immediate effect with the deletion of registration.
The contract will be terminated with immediate effect in the case of a breach of contract with the withdrawal of any of the parties.
After the termination of contract, the parties will not assert any claims against each other.

6. User comments, feedbacks, and suggestions

Myenglishteacher.eu shall obtain unlimited and exclusive rights of use on the comments, remarks, feedbacks, suggestions, ideas and any other suggestions expressed, presented, or offered for Myenglishteacher.eu regarding the use of the website (referred to as “comments”).

7. Exclusion of liability

Myenglishteacher.eu excludes any liability for damages arising as a result of service stoppage, and/or as a result of an accidental loss of business-related or personal information or any other financial losses.

Myenglishteacher.eu cannot be at any time held responsible for any damage caused by the performance or inadequacy of the software, and for possible failures that can be connected with the other software applications running at the same time with the service.

Myenglishteacher.eu does not guarantee that the access to the website will be without failure or disorder. Myenglishteacher.eu explicitly excludes the liability for the damages and/or losses deriving from the access, indirect or direct use of the website, information and documents available there, also from the unusable state, improper operation, deficiency or incidental malfunction of the website, or any misunderstanding.

Myenglishteacher.eu shall not be liable regarding the information and services provided by Members on the website of the service, especially regarding information, contents, products and services obtained from third parties. By using the website, the Member acknowledges that he/she is using it on his/her own responsibility – Myenglishteacher.eu shall not take any responsibility for the damages occurred in the computer of the Member or in any other respect in relation with the use the website. Myenglishteacher.eu excludes any liability which derives from the download, incidental failure or the incompatibility of the programme with other programs running on the computer of the Member or which derives from any internet virus.
The Member is responsible for the contents of his/her e-mails, messages, datasheet, and photo. Myenglishteacher.eu excludes any liability for damages arising from e-mails, messages, datasheets, and photos of Members, respectively from their forwarding. The Member is fully responsible for the use of any service, which includes the use of the Member’s password. In this regard, please keep your password secret and secure.

8. Service maintenance

Myenglishteacher.eu is entitled to suspend the Service without any prior information or notice in order to maintain the website.
The Member acknowledges that the continuous operation may break down in contempt of the prior knowledge or intent of Myenglishteacher.eu.

9. Protection of copyrights

The Member acknowledges that every right related to Myenglishteacher.eu notions and emblems, and to emblems and notions phonetically or visually similar to them is owned by Myenglishteacher.eu.

The Member cannot use the above trademarks and the trademarks similar to them as his/her own.

The websites, their contents, or any of their details of the Myenglishteacher.eu service are protected by copyright.

The Myenglishteacher.eu logo and the Myenglishteacher.eu product names are commercial trademarks of Myenglishteacher.eu.

It is forbidden to use, reproduce, transmit, disseminate, modify or store whole or partial contents of websites in any form without the prior written consent of Myenglishteacher.eu.

Myenglishteacher.eu reserves the right to modify or alter the websites of the service, and to limit or terminate their availability at any time.

10. Website security

The Member agrees that he/she shall not use any device, software or procedure that may distract or try to distract the operation of the website according to its function or any activity on the website. Violating the security of the system or the network may result in civil or criminal consequences.

11. Data protection

With the registration, the Member agrees to receive maximum 5 Myenglishteacher.eu newsletters per year.

The privacy policy rules related to the service are included in the separate Privacy Policy Statement available on the website of Myenglishteacher.eu. By completing the registration, you accept the terms of this Agreement and you also indicate that you understand and consent to the information collection, use, and disclosure practices described in our Privacy Policy.

The Member acknowledges that the data on his/her datasheet are available and can be searched by other Members and non-registered visitors.

12. Payment conditions

The Member agrees to pay for the use of the service. Myenglishteacher.eu will issue an invoice on the service according to the chosen payment method. The Member is responsible for the payment of every fee on time.

• Money transfer initiated by the Member,
• PayPal.

The data provided by the Member is controlled by the involved bank; the service will be available for the Member only after the bank’s approval. Myenglishteacher.eu declares that it has no access to the data mentioned in this section; it does not store them, and does not take any responsibility for any possible misuse arising during the use of the debit card.

13. Prices

The current fees for services of Myenglishteacher.eu are available on its website. The service of Myenglishteacher.eu can be used according to a Pay-as-you-Go system. The Member is entitled to use the service after buying credits. Myenglishteacher.eu reserves the right to change prices at any time. The indicated prices are gross prices, including VAT.

Myenglishteacher.eu is liable only for its own malpractices and maximum to the extent of the sum of the current transaction.

14. Other provisions

The parties stipulate the exclusive jurisdiction of the Pest Central District Court or the Metropolitan Court of Budapest, according to their jurisdiction. With complaints regarding the General Terms of Use, the Member can apply to the General Inspectorate for Consumer Protection. The user may not assign any claim arising out of the use of this service without the prior written consent of Myenglishteacher.eu.
